Terms of Service — Velocity

These Terms of Service ("Terms") govern your use of the Velocity mobile application ("Velocity," "the App," "we," "us," or "our"), operated by Moncef Samai. By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Velocity. By using the App, you represent that you meet this requirement. If you are between 13 and 18, you must have your parent's or guardian's consent.

2. Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

We may suspend or terminate your account if you violate these Terms or if we reasonably believe your account has been compromised.

3. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Velocity on devices you own or control, solely for your personal, non-commercial use.

4. Subscriptions and Billing

4.1 Plans

Velocity offers the following plans:

Prices are in USD and may vary by region due to App Store currency conversion.

4.2 Billing

Subscriptions are billed monthly through the Apple App Store. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.

4.3 Cancellation

You may cancel your subscription at any time through your Apple ID account settings (Settings → [Your Name] → Subscriptions). Cancellation takes effect at the end of the current billing period; you retain access until then.

4.4 Refunds

All purchases are processed by Apple. Refund requests must be made directly through Apple at reportaproblem.apple.com. We do not issue direct refunds.

4.5 Price changes

We will provide at least 30 days' notice before increasing subscription prices. Continued use after a price change takes effect constitutes your agreement to the new price.

5. Not Medical Advice

Velocity provides training guidance and biomechanics feedback for informational and athletic performance purposes only. It is not a medical service and does not provide medical advice, diagnosis, or treatment.

Before beginning any new training program or if you have a pre-existing injury or medical condition, consult a qualified physician or sports medicine professional. Do not use Velocity as a substitute for professional medical advice.

We are not responsible for any injury, health consequence, or other harm arising from training plans, coaching cues, or biomechanics feedback generated by the App.

6. AI-Generated Content

Velocity uses artificial intelligence to generate training plans and coaching cues. AI output is:

• Generated probabilistically and may contain errors
• Not reviewed by a human coach before delivery
• Not a substitute for professional coaching or medical guidance

You are responsible for evaluating AI-generated content before acting on it.

7. Camera and Data

By using the Form Tracker feature, you consent to the capture and transmission of short video clips to our analysis server for biomechanics scoring. Clips may be retained for a period of time to support quality improvement and product development. See our Privacy Policy for full details.

8. Acceptable Use

You agree not to:

• Use Velocity for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Access the App through automated means (bots, scrapers)
• Circumvent subscription paywalls or access restrictions
• Upload content that is harmful, illegal, or violates third-party rights
• Share your account credentials with others

9. Intellectual Property

All content, features, AI models, and infrastructure in Velocity are owned by Moncef Samai or licensed to us. You may not copy, reproduce, distribute, or create derivative works from any part of Velocity without prior written permission.

Your training data remains yours. We claim no ownership over the personal fitness data you enter into the App.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MONCEF SAMAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF VELOCITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) CAD $50.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Moncef Samai from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to Velocity at any time for any reason, including violation of these Terms. You may terminate your account at any time through Settings → Danger Zone. Upon termination, your license to use the App ends and, upon your request, we will delete your data in accordance with our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of Canada, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Canada.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through in-app notice. Continued use of Velocity after changes take effect constitutes acceptance of the updated Terms.
