End User License Agreement (EULA) — Velocity
Effective date: May 13, 2026
This End User License Agreement ("EULA") is a legal agreement between you ("End-User") and Moncef Samai ("Licensor") for the Velocity mobile application ("App").
By downloading or using the App, you agree to be bound by this EULA.
1. Acknowledgement
You and Moncef Samai acknowledge that this EULA is concluded between you and Moncef Samai only, and not with Apple Inc. ("Apple"). Moncef Samai, not Apple, is solely responsible for the App and its content.
2. Scope of License
Moncef Samai grants you a non-transferable license to use the App on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
This license does not allow you to:
- Use the App on any device you do not own or control
- Distribute or make the App available over a network where it could be used by multiple devices at the same time
- Rent, lease, lend, sell, redistribute, or sublicense the App
- Copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, or modify the App or any part of it
3. Maintenance and Support
Moncef Samai is solely responsible for providing maintenance and support services for the App, as required under applicable law. Apple has no obligation to furnish any maintenance and support services for the App.
4. Warranty
Moncef Samai is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Moncef Samai's sole responsibility.
5. Product Claims
Moncef Samai, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including:
- Product liability claims
- Claims that the App fails to conform to any applicable legal or regulatory requirement
- Claims arising under consumer protection, privacy, or similar legislation
6. Intellectual Property
In the event of any third-party claim that the App or your possession and use of the App infringes a third party's intellectual property rights, Moncef Samai, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
7. Legal Compliance
You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Third-Party Terms
The App uses third-party services (Supabase, Stripe, Anthropic) which are subject to their own terms of service. Your use of the App constitutes acknowledgment and acceptance that you may be subject to those terms.
9. Governing Law
This EULA is governed by the laws of Canada. Any disputes shall be resolved in the courts of Canada.
10. Third-Party Beneficiary
You and Moncef Samai acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
